Government plans to introduce Communications Bill to replace Telegraph Act and TRAI Act

The government is planning to introduce the Communications Bill that will seek to replace all old legislations pertaining to the communications sector, including the Telegraph Act and Telecom regulatory Authority of India (TRAI) Act. Through this bill, the government is planning to introduce a new regulatory authority for the sector, to be known as the Communications Commission, to replace the existing regulatory authority, TRAI. 

The Bill proposes that the Communications Commission comprise a six-member panel, with one chairman having a five-year tenure. The members of the commission will include one each from domains like telecom, broadcasting, finance, management, accountancy and either law or consumer affairs. The proposed Communications Commission will retain the functions and the powers currently held by TRAI and will also oversee affairs of some of the other regulators such as the Censor Board, clearances given by the Ministry Of Environment and Forests, the Competition Commission of India and the Department of Telecommunications. 

The Telecom Disputes Settlement and Appellate Tribunal (TDSAT) may also be replaced by Communications Appellate Tribunal, under this bill. The new tribunal is proposed to comprise three members and a chairman. This tribunal is also proposed to be vested with powers to oversee dispute resolution.
